Arbitration
What is Arbitration ?
Arbitration is an alternative dispute resolution method whereby the parties decide to submit their dispute to an Arbitral Tribunal, made up of independent and impartial arbitrators, who will render an enforceable award whose solution will be binding on the parties. Not subject to appeal, the award will benefit from easier circulation within the 172 signatory states of the 1958 New York Convention.
This method of dispute resolution is an alternative to state justice. It ensures that the parties’ dispute is resolved quickly and confidentially.
Arbitration is particularly well-suited to the technical nature of insurance disputes, as it enables the parties to call in experts who can be questioned by the arbitral tribunal and each of the parties at a hearing.
Conducted under the aegis of’ARIAS France, ARIAS FRANCE, an association created in 1995 and governed by the French law of 1901, arbitration in the insurance and reinsurance sector enables parties to have their dispute resolved by industry professionals, whom they can choose — or not — from the list of arbitrators proposed by the Centre. In the event of disagreement as to the constitution of a Tribunal, the ARIAS FRANCE Commission will select one from its extensive international network of arbitration experts specializing in insurance and reinsurance.
ARIAS France is a member of the international ARIAS (AIDA Reinsurance and Insurance Arbitration Society) network of insurance arbitration centers created under the aegis of AIDA (Association Internationale du Droit des Assurances).
This exceptional network makes ARIAS France the reference center for insurance and reinsurance arbitration.
