What is Mediation ?
Lediation is an alternative dispute resolution process in which the parties decide to entrust an independent, impartial third party with the task of helping them resolve their dispute amicably. The mediated solution is not binding on the parties, who must accept it.
Encouraged by the legislator, mediation is developing in a sector-based way, revealing the importance of a greater knowledge of economic players and their practices.
Conducted under the aegis of ARIAS France, Created in 1995 and governed by the law of 1901, arbitration in the field of insurance and reinsurance enables parties to have their dispute resolved by industry professionals, whom they may choose — or not — from the list of mediators proposed by the Centre. In the event of disagreement, the Commission of ARIAS FRANCE will provide this service from its extensive international network of insurance and reinsurance experts.
ARIAS France is, indeed, member of the international ARIAS network (AIDA Reinsurance and Insurance Arbitration Society) created under the aegis of AIDA (Association Internationale du Droit des Assurances). This network enables ARIAS France provide insurance industry players with mediation services tailored to their needs, by mediators who themselves come from this sector and are familiar with the issues involved.
The quality of’ARIAS France is recognized by the French judicial system, since mediators registered on the’ARIAS France are approved by the Paris Court of Appeal.
Close to the concerns of the insurance and reinsurance industries, which experience large volumes of litigation, ARIAS France assures users that its « turnkey » procedure remains inexpensive due to a capped scale.
