What is Mediation ?

Ledi­a­tion is an alter­na­tive dis­pute res­o­lu­tion process in which the par­ties decide to entrust an inde­pen­dent, impar­tial third par­ty with the task of help­ing them resolve their dis­pute ami­ca­bly. The medi­at­ed solu­tion is not bind­ing on the par­ties, who must accept it.

Encour­aged by the leg­is­la­tor, medi­a­tion is devel­op­ing in a sec­tor-based way, reveal­ing the impor­tance of a greater knowl­edge of eco­nom­ic play­ers and their prac­tices.

Con­duct­ed under the aegis of ARIAS France, Cre­at­ed in 1995 and gov­erned by the law of 1901, arbi­tra­tion in the field of insur­ance and rein­sur­ance enables par­ties to have their dis­pute resolved by indus­try pro­fes­sion­als, whom they may choose — or not — from the list of medi­a­tors pro­posed by the Cen­tre. In the event of dis­agree­ment, the Com­mis­sion of ARIAS FRANCE will pro­vide this ser­vice from its exten­sive inter­na­tion­al net­work of insur­ance and rein­sur­ance experts.

ARIAS France is, indeed, mem­ber of the inter­na­tion­al ARIAS net­work (AIDA Rein­sur­ance and Insur­ance Arbi­tra­tion Soci­ety) cre­at­ed under the aegis of AIDA (Asso­ci­a­tion Inter­na­tionale du Droit des Assur­ances). This net­work enables ARIAS France pro­vide insur­ance indus­try play­ers with medi­a­tion ser­vices tai­lored to their needs, by medi­a­tors who them­selves come from this sec­tor and are famil­iar with the issues involved.

The qual­i­ty of’ARIAS France is rec­og­nized by the French judi­cial sys­tem, since medi­a­tors reg­is­tered on the’ARIAS France are approved by the Paris Court of Appeal.

Close to the con­cerns of the insur­ance and rein­sur­ance indus­tries, which expe­ri­ence large vol­umes of lit­i­ga­tion, ARIAS France assures users that its « turnkey » pro­ce­dure remains inex­pen­sive due to a capped scale.
